I submit this waiver on behalf of myself, OR as the legal guardian of the minor named above (hereinafter referred to as the PARTICIPANT) who is/will be participating in an ice program or private ice rental at OIC Enterprises Ltd. dba Ultimate Hockey Centre (hereinafter referred to as the UHC).
I agree to hereby RELEASE, WAIVE, DISCHARGE the UHC, its owners, employees and agents, from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of, or related to any loss, damage, illness (including COVID-19) or injury, or death, that may be sustained by my child, myself or my guests to any property belonging to me, while participating in such activity, while in, on or upon the premises where the activities are being conducted, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law.
As or on behalf of the PARTICIPANT I also agree to the following conditions:
All participants are required to wear full equipment including a CSA approved helmet at all times while on the ice.
Children (under 19) are required to wear a CSA approved helmet while on the bench as well.
All participants are required to carry up-to-date private or government health insurance.
Commercial user groups (instructors, hockey/skating camp organizers, hockey associations, etc) are required to carry all necessary insurance during the time of the rental to indemnify and hold OIC ENTERPRISES LTD. operating as The Ultimate Hockey Centre, harmless from all expenses, costs and liabilities in connection with any claim that may be presented or asserted against it.
Only participants who have submitted waivers are permitted on the ice or in the bench area.
When the ice surface is to be conditioned by the Ultimate Hockey Centre staff, all players/coaches/referees will immediately leave the ice surface and remain off the ice until the ice machine has left the ice surface and an attendant has closed and secured the Zamboni gate. Water bottles and other equipment must not be left on the boards while the Zamboni is conditioning the ice.
*During this reopening period, while dressing rooms are off limits, minors must be supervised on the bench at all times while the Zamboni is in operation.
All garbage and other materials brought on site by the user are expected to be removed from the building or disposed of appropriately by the user in a garbage can or recycling container. A fine may be levied upon the user if in violation of this policy. Equipment and other items left behind by users are subject to disposal by UHC staff. The UHC is not responsible for any lost, stolen or damaged articles resulting from use of the facility.
* During this reopening period, we are limiting user groups to a maximum of ten people, including instructors. Users must provide a minimum of 1 adult supervisor on the ice for every 4 skaters under the age of 19. Spectators are not permitted at this time.
Children 12 or under may not be dropped off and left at the facility without an adult from the child/children’s user group present.
All users agree to maintain discipline among their group members and ensure appropriate conduct while using the facility. Vandalism, abuse of staff and volunteers, littering and any other behaviour that is disruptive to other users and employees, or is in any way inappropriate or in violation of the policies outlined here will not be tolerated and users will also be held liable for any damage to the facility or its equipment resulting from negligent use, irresponsible behaviour or violations of any of the policies outlined here by the user(s) or any individuals associated with his/her party. This policy extends to the family members, siblings and friends/associates of the user(s) attending the facility during the user’(s) allotted rental period.
The UHC reserves the right, without notice to refuse service, eject and/or suspend temporarily or permanently, at its discretion and without compensation or reimbursement any user of the facility for behaviour that is disrespectful, abusive and/or poses a danger to staff, other players, officials and/or other users/customers/guests and/or poses a risk of damage to the facility and/or its equipment. This may result in expulsion from the premises and/or future suspension of rental privileges along with a fine. We expect all players and guests using the UHC to treat the facility with the same respect and consideration they would expect observed at their own homes.
In the event an ice booking or program is delayed, postponed or cancelled for any reason, including but not limited to facility closure, the UHC WILL NOT PROVIDE REFUNDS. Instead a credit for any amount already paid will be applied to the customer’s account and may be redeemed towards future ice rental(s) or program registration(s), subject to availability.
The Ultimate Hockey Centre is a clean facility.
Smoking/Vaping/Alcohol/Drugs are not permitted anywhere on the grounds and use or consumption of any is strictly prohibited at all times. User groups will be held responsible for any liability resulting from the consumption of alcohol/drugs/cigarettes/vape by any persons connected or associated with their group.
All participants agree to grant and release to the UHC the right to use photographs, audio tapes, and/or videotapes in which I and/or my children and my guests appear in any materials such as videos, films, recordings, still photographs or articles relating to the UHC including, but not limited to, brochures, newsletters, annual reports or any other advertising and/or promotional materials whether broadcast on television, radio or any other medium.

As or on behalf of the PARTICIPANT I also agree to the following extraordinary conditions specific to the UHC’s COVID-19 response.
The following rules are in effect during the UHC’s limited operation in order to minimize the transmission of the COVID-19 virus in our facility. These rules will be strictly enforced. Customers and their guests violating any of these rules may be subject to immediate expulsion from the facility and possible future suspension.
Any user experiencing symptoms of the virus or who has been exposed to anyone experiencing symptoms of the virus is prohibited from entering our facility.
The facility will be closed to the general public with the exception of clearly marked areas which will be accessible by users for the duration of their ice rental only.
Dressing rooms (including the referee’s dressing room), main lobby (including lobby washrooms, upstairs mezzanine and ice-level viewing areas will all be off limits until further notice. Customers will not be permitted to ‘store’ equipment in a dressing room or anywhere in the facility.
A maximum of 10 users will be permitted (including instructors) per ice session.
All customers are required to arrive fully dressed.
The main entrance door to the facility will remain locked at all times. Users will be required to enter the building through the secondary side door.
The secondary side door will be unlocked and opened no sooner than 10 minutes prior to an ice booking. Customers (not of the same household) arriving before the doors are open are required to line up on the red pavement markings outside, observing social distancing protocols by maintaining a 2 metre (6 foot) distance from other users at all times.
Customers may enter the building only after a UHC staff member has signalled that it is safe to do so.
Upon entering the building all users are required to use the wall mounted hand sanitizer located in the hallway, next to the washroom and make their way directly to the ice area, continuing to maintain social distancing at all times (if not all from the same household).
Once in the building customers are required to make their way directly into the rink area where clearly marked, socially distanced seating will be provided.
For user groups where all users are not from the same household, social distancing should be observed on the ice at all times. This means games are prohibited and instructors are advised to adjust their programs to allow for skaters to maintain a reasonable distance from one another while on the ice.
Spitting is strictly prohibited anywhere in the facility.
Water bottles are to be labeled and filled off-site. The dressing room water dispenser will be unavailable. Sharing of water bottles is strictly prohibited while in the facility.
The dressing room hallway washroom is available for emergency use only.
Users must exit the building through the secondary entrance door no later than five minutes following completion of a scheduled ice session.
Customers are asked to refrain from group gatherings in the parking lot prior to or following their scheduled ice booking.
We recognize these temporary limitations are not optimal, however they are necessary in order for the UHC to maintain compliance with current Provincial Health Authority COVID-19 guidelines. We will notify customers of any changes to these policies as restrictions are removed. Unless otherwise stated, the above policies apply until further notice.

IN SUBMITTING THIS AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT I am the PARTICIPANT listed above or the legal guardian of the child listed as the PARTICIPANT above and have read the foregoing Waiver of Liability and Usage Agreement, understand it and agree to it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least nineteen (19) years of age and fully competent; and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by same.
